Retainers, Deposits, and Payments
1. The date of the event is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the order and delivery charges.
2. The final payment is due 15 days prior to party or wedding events.
3. If the cake is booked 7 days or less before the event, the deposit will equal 100% of the total value.
4. If the Client fails to make payments, Crave Pasticceria will cease work, the order will be cancelled, and no refund will be given.
5. The Client will have a grace period of 2 days after the payment date to pay the debt before the contract is cancelled.
Liability
6. The Customer is liable for any damage, accident or mishap that may occur once the custom cake is released from the care and custody of Crave Pasticceria. Crave Pasticceria is not liable for any damages that may occur thereafter.
7. Crave Pasticceria is not responsible for bodily injury, property or consequential damage, which may result from services.
8. Crave Pasticceria is not responsible for any damage to the cake or shortage (cut or piece missing) of cake caused by anyone NOT employed by Crave Pasticceria.
9. Crave Pasticceria will not deliver a cake if payments have not been paid in full.
10. Non-edible items (such as cake toppers, cake boards, food wrappers, floral wires, wooden/plastic dowels, flowers, etc.) may be used as decorations on or structures within your cake. It is your responsibility and obligation to ensure that any non-edible items are removed prior to consumption. Crave Pasticceria will not be held liable for the consumption of non-edible items outside our premises.
Postponement/Cancellation
11. The Client must notify Crave Pasticceria if there is a change in the date of the event or a complete cancellation.
12. If the postponement occurs before 30 days of the event, no penalty fee will be charged.
13. If the postponement occurs after 14 days prior to the event, the Client will be charged 50 percent of the agreed fee.
14. If a cancellation occurs 30 days prior to the date of the event, all money will be refunded minus the retainer fee.
15. If a cancellation occurs after 14 days prior to the event 50% will be refunded less the non-refundable retainer fee.
Changes to Order
16. Any changes (size, style, flavors, color, etc.) must be submitted two (2) weeks in advance. Changes cannot be guaranteed and may be subject to additional charges.
17. There will be no changes allowed two weeks prior to the event.
Cake Design
18. By paying for this cake you agree that certain creative changes may be made to your final design for the sake of stability, structural integrity or other certain emergencies.
19. Crave Pasticceria cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar but not be held liable for these discrepancies.
20. Seasonal items may incur an additional charge or may be substituted if not available for time of delivery.
Serving Amount & Sizes
21. The serving size is 2x1x6(Dessert serves) or can be cut in two to give 2x1x3(Coffee serves)
22. Cake sizes can be discussed with one of our team members to select the size that works best for your event.
23. Servicing size estimations are not guaranteed to be exact.
24. Crave Pasticceria is not responsible for a shortage of cake if the pieces are cut too large.
Allergy & Dietary Warnings
25. Crave Pasticceria’s products may contain or come in contact with milk, wheat, nuts, cocoa or other allergens. While every precaution will be taken in the cases of known allergies, it remains the full responsibility of the Client to inform guests of possible allergens. Crave Pasticceria is not responsible for any allergic reaction.
26. Crave Pasticceria will not be held liable for the following as fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.
Delivery and Set up
27. There is a delivery fee of P250 within city limits. Outside city limits require a mutual agreement as to cost.
28. Crave Pasticceria is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labour troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Crave Pasticceria’s control.
29. If Crave Pasticceria has completed the cake but it can’t be delivered due to uncontrollable circumstances, The Client will be refunded 50% of the total cost.
30. Client will provide clear delivery instructions to location and inform Crave Pasticceria of any adverse conditions or obstacles that may hinder the delivery and affect the quality of finished cakes).
31. The Client must sign a waiver to ensure the condition of the cake is satisfactory.
32. Once the waiver is signed, Crave Pasticceria is not responsible for cake including collapse, melting, pokes, etc.
33. After satisfactory delivery and set up by Crave Pasticceria, Client assumes full responsibility for the condition of the cakes. If Client elects a representative to pick up and set up the cake, Client assumes full liability and responsibility for the condition of the cake once it leaves Crave Pasticceria’s possession
34. Outdoor Delivery Disclaimer: Client understands that Crave Pasticceria is not responsible for the condition of products following outdoor setup. Due to the effects of outdoor weather conditions, table on unlevel ground, wind blowing undesirable atmospheric items (e.g., dirt, leaves, or branches), sunlight, insects and other wildlife, it is understood that products such as icings, fillings, cake decorations, etc, may not hold up and cannot be insured past satistactory delivery. HEAT: Buttercream can melt and therefore are not recommended for outdoor events in temperatures exceeding 80 degrees. HUMIDITY: Fondant Cakes do not do well in humidity, they can melt and/or bubble.
35. The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, etc.) and placed in a stable surface, suitable outdoor setting and optimal temperature. Crave Pasticceria is not responsible for any damages to the cake caused by a guest, caterer, or any other person not employed by Crave Pasticceria.
Pick ups
36. Products are to be collected from our premises at a pre-arranged time and date as agreed between ourselves and the customer. Transport the cake on the floor, preferably front seat of your passenger vehicle or in the trunk of an SUV. Never transport cakes on the front or back seat of the car. Be sure to drive slowly and take it easy around corners. Cool air-conditioning is required at all times when transporting products. Cakes must be collected within one hour of your arranged pick-up time (unless previously discussed with us on the day). If you are running late or held up, call us! Delays will compromise your product and we are not responsible for quality after pick-up date.
Photographs
37. Crave Pasticceria reserves the right to use all photographs of baked goods and cakes for advertising and promotional purposes without compensation.
It is strongly recommended that customers familiarize themselves with our products and website prior to making an inquiry with us. Upon requesting a quote, we reserve the right to assume you have read our disclaimer pages and it is noted that these terms are automatically agreed upon payment of a deposit. By paying for this cake it is an act of signing this contract that is legal and binding to the fullest extent of the law.
